La guerre des ondes – Le véto de Washington entre les bélligerants

La guerre des brevets reste vive entre les géants de la technologie. On parle bien évidement de Samsung et d’Apple qui s’opposent sur le terrain judiciaire dans 10 pays différents au sujet des brevets et d’autres droits respectifs en matière de propriété industrielle. Cette fois-ci, ils ont occupé les médias pour une raison plus originale qu’à l’accoutumée : le veto de l’administration d’ObamaScreen Shot 2013-08-13 at 12.22.07 π.μ.

Je tiens à m’expliquer : le 4 juin 2013,  l’ITC a statué qu’Apple contrefaisait desbrevets détenus par Samsung electronics. Le délit concernait les anciens modèles d’Apple, l’iPhone 3GS et 4 ainsi que l’iPad 1 et 2. En conséquence, le tribunal a ordonné pour la première fois, l’interdiction de vente des appareils d’Apple concernés sur le territoire américain.  La décision pourrait ne pas se montrer trop grave vue l’ancienneté des produits d’Apple interdits, mais constituait sans doute, un frein à sa politique commerciale. Cependant, cette mesure n’était pas appliquée la semaine dernière comme prévu, car le gouvernement américain a usé de son droit de veto.

Corporate espionage at the british technology titan Dyson ?

An unproven Chinese spy in the middle of an industrial espionage scandal has been named as Dyson, the vacuum cleaner constructor, seeks the return of its top secret technology. Dyson claims Yong Pang, an engineer focusing on electric motors, was paid more than 13,000 EUR by a German competitor to pass on the technology, which is at the core of future product development.
They say that Bosch, which employs 70 times the number of staff across the world, then shared what it learned with their Chinese manufacturer. Pang was working as a senior motor-drive engineer at Dyson’s headquarters in Malmesbury, Wiltshire, from June 2010 until he was dismissed for gross misconduct in June last year, according to papers lodged with the High Court.
He had worked at Bosch from April 2006 to December 2008 and then went on to work for the international engine manufacturer Ricardo. An internet entry says he worked as an electric machine design engineer for Ricardo and lived in Ipswich, Suffolk.

A new multi-million patent dispute is on the rise – This time it’s Google VS Microsoft !

Google Inc. made a $12.5 billion deal to buy Motorola’s mobile phone division, a move that could reshape the Internet giant’s future in the mobile world while also giving it an arsenal of patents for a real legal war with Apple.
The purchase of Motorola Mobility Holdings Inc., by far the largest in Google’s history, moves the Internet company into the arena of making smartphones, tablet computers and cable set-top boxes. It will nearly double Google’s work force and test the company’s young alliance with other cellphone makers.

If the driving motivation behind Google’s $12.5 billion acquisition of Motorola Mobility was the company’s patent arsenal, the search giant isn’t seeing much return on that huge investment.

This week, Google’s Motorola division had yet another setback in its ongoing intellectual property dispute with Microsoft, when a judge dismissed some of the patent claims it had deposed against the software company.

Apple can use the name “Lightning” for its new iPhone, iPad and iPod connector, but that’s because the company acquired the rights from an unlikely place: motorcycle maker Harley-Davidson.
The acquisition showed up in a European trademark filing, and gives both companies the right to use the term. The trademark covers items such as electrical parts for motorcycles, helmets and turn signals, along with items that aren’t usually associated with motorcycles like computer games, televisions, and eye glasses.

A new year and a new patent for Apple

Two years after Apple introduced its first unibody computer in the MacBook Air, the company has officially been granted ownership of its unique design and manufacturing process.

The US Patent and Trademark Office formally issued a granted patent of Apple’s relating to the unibody MacBook Pro’s enclosure.
Apple’s VP of Industrial Design Jonathan Ive described the MacBook Pro’s patented design in 2011 this way: “the assembly may include an integral unified (e.g., homogenous) top case formed from a single part. The integral top case provides an enclosure, frame and cosmetic exterior of the portable computer. The integral top case also functions as the primary structure of the portable computer.

Unitary patent approved : after satisfaction, worry

The European parliament approved the unitary patent on Tuesday 11th. 40 years of discussions, disagreements, hopes. If all countries agreed with the idea of a unitary patent they did not agree on terms.

Finally, an agreement was found, but without Italy and Spain. As a consequence, the unitary patent provides protection in 25 countries. The unitary patent is really necessary to raise competitiveness of European companies as it is reducing costs. Today, the approximate cost of a patent filed for the 27 european countries is 32 000 € compared to 1 850 € for a patent filed in the United States.
